Service
|
The Service is based in the UK, aimed at UK residents and intended for access and use by UK residents
only. Unless explicitly stated otherwise, any future developments or new features, including the release
of new website properties, shall be subject to the Terms.
All Users are hereby licensed to use Phonewebcam and to download and use our client software and connect
to our servers for the sole purpose of using Phonewebcam, subject to their compliance with these Terms.

To use the PC applications, you must provide all equipment, including
a computer and modem or other access device necessary to establish a connection to the World Wide Web,
and pay any service fees associated with such access.

To use the Phonewebcam Viewer, you must have a Java-enabled handset
with internet connection, and pay any operator charges associated with such access.
|
|
You understand and agree that the Service is provided on an "AS-IS" and "AS AVAILABLE" basis, and at
your own risk. OTAMate Technology assumes no responsibility for the timeliness, deletion, misdelivery,
failure to store or unauthorized access to any User Content.
You must not misuse any of our customer service facilities. You must not deliberately enter false
information into any of the forms on our Site, or in Phonewebcam products.
Where a third party service or content provider ("Provider") is identified as providing a particular
service or application forming part of the Service then you may also be contracting directly with such
Provider and your access to and use of that service or application may be subject to additional terms
and conditions. For the avoidance of doubt in using any such Provider service you will still be bound
by these Terms to the extent they are applicable.

Provision of service
|
You must not reverse-engineer, decompile or modify the Phonewebcam products in any way. You must not use
a modified/customised version of Phonewebcam. You must not create or provide any other means by which
Phonewebcam may be used by others (including, without limitation, replacement or modified client/server
software, server emulators).
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any
portion of the Service, use of the Service, or access to the Service without our prior written consent.
We will make reasonable commercial efforts to ensure that the Service is available 24 hours per day
without any interruptions. However, we reserve the right to make the service unavailable at any time or
to restrict access to parts or all of the service without notice.
OTAMate Technology reserves the right at any time and from time to time to modify or discontinue,
temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that
OTAMate Technology shall not be liable to you or to any third party for any modification, suspension
or discontinuance of the Service.

Parental guidance
|
Whilst we reserve the right to monitor and take action upon inappropriate use of the service (including
the posting of inappropriate or offensive material via the forum facility or otherwise), we cannot
guarantee that the service will not contain any content provided by third parties that is inappropriate,
offensive or otherwise objectionable.

Your contract with us
|
Your contract with us shall begin upon the earlier of you:

completing our registration process and confirming that you have read
and accepted these Terms; or |
| • |
viewing, accessing or using any Service offered by us which does not
require registration.

These Terms, including any other posted guidelines and amended terms, shall
apply to all of the Services. In addition to these Terms, there may be additional terms and conditions
which apply to individual Services which you will be required to accept when registering for that Service.

Account and Password
|
We reserve the right to delete all your accounts, block your access to our Site and Services, and/or
take further legal action if you violate any of these Terms. We may delete or modify any account at any
time for any reason.
You agree to keep your Password safe at all times and not to disclose it to any other person. You must
ensure that your computer and mobile device is kept free of viruses and Trojans to ensure the safety of
your password. Genuine OTAMate Technology staff will never ask you for your current password.
You agree that your Phonewebcam account, Products and Services are and remain the property of OTAMate
Technology. You may not sell, transfer or lend your account to anyone else, or permit anyone else to use
your account, and you may not accept an account which anybody else offers you.

Registration

In order to relay camera images to mobile phones, you will be asked to
register the Publisher by providing your Account ID, a unique password and other personal information as
prompted for by the registration wizard ("Registration") |

You are responsible for maintaining the confidentiality of the password and account, and are fully
responsible for all activities that occur under your password or account. Your right to access the
Service is intended for personal use and is non-transferable. You agree to immediately notify OTAMate
Technology of any unauthorized use of your password or account or any other breach of security. OTAMate
Technology will not be liable for any loss or damage arising from your failure to comply with this
provision. |

In consideration of your use of the Service, you agree to: (i) provide
true, accurate, current and complete information about yourself ("Data") when Registering and (ii) maintain
and promptly update the Data to keep it true, accurate, current and complete. If you provide any Data that
is untrue, inaccurate, not current or incomplete, or OTAMate Technology has reasonable grounds to suspect
that such Data is untrue, inaccurate, not current or incomplete, OTAMate Technology has the right to
suspend or terminate your account and refuse any and all current or future use of the Service.

Subscription
|

In order to view camera images on a mobile phone or to restrict who can
view your private camera, you are required to either "Subscribe" if you do not have an Account, or
"Top up" if you have an existing Account. |

If you elect to purchase subscription-based content/services and transmit to us a subscription/top up
purchase request, you warrant that all the information that you submit is true and accurate (including
without limitation your credit card number and expiration date, and other payment details), and you agree
to pay all subscription fees you incur including all applicable taxes. |

Users subscribing for the first time will be required to provide Registration details as described in
Registration. |
| • |
By subscribing to receive the Phonewebcam Viewer, you agree that your
mobile phone is (i) java-enabled, (ii) can receive wap push messages, (iii) is correctly configured for
http internet connection and (iv) has no operator restrictions preventing use of the service.
